GENERAL TERMS AND CONDITIONS OF SALE
Article 1 – Purpose
These General Terms and Conditions of Sale (GTC) govern the commercial relations between the company Marie Meerson SAS (hereinafter "the Seller") and any buyer (hereinafter "the Client") via the mariemeerson.com website.
Article 2 – Products
The Seller offers three categories of products:
- Original artworks: paintings and signed photographic prints
- Eco-responsible textile creations
- LTDMAP photographic sessions
Each artwork is unique or produced in a limited series. Product photographs are as faithful as possible, but slight color variations may exist depending on screens.
Article 3 – Prices
Prices are indicated in euros (€), all taxes included (TTC). The Seller reserves the right to modify its prices at any time. Products are invoiced at the rate in force at the time of order validation.
Article 4 – Order
The order is validated after payment confirmation. A confirmation email is sent to the Client. The Seller reserves the right to cancel any order in case of stock shortage or payment issue.
For photographic sessions, the reservation is confirmed after payment and acceptance of the withdrawal conditions.
Article 5 – Payment
Payment is due upon order. Accepted payment methods are those offered during checkout (credit card, etc.). Transactions are secured.
Article 6 – Shipping and delivery
Shipping conditions and delivery times are detailed in our Shipping Policy. Risks related to transport are borne by the Client as soon as the package is handed over to the carrier.
In case of a damaged product upon delivery, the Client must report it within 48 hours and contact the Seller for an exchange or refund.
Article 7 – Right of withdrawal and exceptions
7.1 General right of withdrawal
In accordance with article L.221-18 of the Consumer Code, the Client has a period of 14 days from receipt of the product to exercise their right of withdrawal, without justification.
7.2 Return conditions for original artworks (paintings and signed prints)
Original artworks can be returned within 14 days. The product must be returned in its original condition, undamaged, unused, and in its original packaging. Return shipping costs are borne by the Client.
Exception: Custom-made or personalized artworks are excluded from the right of withdrawal (article L.221-28 of the Consumer Code).
7.3 Return conditions for eco-responsible textiles
Textile creations can be returned within 14 days if they are in their original condition: unused, unwashed, with the tag intact, and in their original packaging. Return shipping costs are borne by the Client.
7.4 LTDMAP Photographic sessions – Non-refundable
Photographic sessions are considered a service executed once completed. No refund can be requested after the session, even in case of dissatisfaction. The Client accepts this condition before finalizing their reservation.
Cancellation by the Client: Cancellations must be made at least 7 days before the session. Cancellations made within 7 days prior to the session are non-refundable and non-reschedulable. Cancellations made at least 7 days in advance can be rescheduled to an available slot.
The Seller reserves the right to cancel a session in case of circumstances beyond its control. In this case, a full refund will be issued or a postponement proposed.
Article 8 – Refunds
Upon receipt and verification of the returned product, the refund will be made within 14 days via the original payment method. Products not meeting the return conditions will not be refunded and will be returned to the Client.
Article 9 – Legal guarantees
The Client benefits from the legal guarantees of conformity (articles L.217-4 et seq. of the Consumer Code) and against hidden defects (articles 1641 et seq. of the Civil Code).
Article 10 – Liability
The Seller cannot be held responsible for damages resulting from improper use of the products or from a case of force majeure.
Article 11 – Intellectual property and image rights
Sold works are intended for private use only. Any reproduction or commercial exploitation without written authorization is prohibited.
The Seller owns the photographic files resulting from LTDMAP sessions. The Client agrees that their photographs may be used by the Seller for promotional purposes (website, social media, portfolio, publications). To refuse the promotional use of their photos, the Client must notify their refusal in writing before the session.
Article 12 – Online right of withdrawal
To exercise your right of withdrawal, the Client must use the withdrawal form available on the mariemeerson.com website or contact the Seller at contact@ltdmap.com stating their order number.
Article 13 – Mediation and disputes
In case of a dispute, the Client may resort to an accredited consumer mediator. French law is applicable. Failing amicable resolution, French courts will have jurisdiction.
